ABOUT THE MARYLAND PROPERTY CONDITION
DISCLOSURE/DISCLAIMER STATEMENT

Maryland offers many consumer protections in connection with purchasing a home in Charles County or elsewhere in the state.

All sellers are required to provide home buyers with a:

MARYLAND RESIDENTIAL PROPERTY DISCLOSURE AND DISCLAIMER STATEMENT
The seller has the option of providing a detailed statement of property condition OR the seller may elect to DISCLAIM and knowledge. However, sellers are required to disclose any KNOWN material defects.

Items covered in the Property Disclosure Statement include but are not limited to:

Water, Sewage, Heating & Air Conditioning including Foundation, Basement, Roof, Structure, Plumbing, Heating Systems, Air Conditioning Systems, Electric Systems, Smoke Detectors, Septic System, Water Supply, Fire Sprinkler System, Insulation, Exterior Drainage, Gutters and Downspouts.

In addition to the above, the seller must disclose any knowledge pertaining to:
Wood-destroying insects, regulated materials (buried fuel tanks, asbestos, radon gas, lead-based paint), Zoning violations, building restrictions, easements.

The seller must disclose to the buyer if the property is located in a flood zone, conservation area, wetland area. Whether the property is covered by a Home Owners Association or other type of community association.

MARYLAND RESIDENTIAL PROPERTY DISCLAIMER STATEMENT

Sellers may elect to provide buyers with a Disclaim Statement. The owner(s) make no representations or warranties as to the condition of the property. By providing buyes with a DISCLAIMER STATEMENT, the seller sells the property in "AS IS" condition. The buyer may still propose a contract with a Home Inspection Contingency and the seller may agree to the Home Inspection.

However, the seller is required to disclose to the buyer any latent defects.
