THE HOME INSPECTION FOR HOMES IN WALDORF
What is covered and what you can expect.
As a part of the Contract of Sale, Maryland home buyers have an opportunity to have a property
inspection by a competent home inspector. Sellers do not have to agree to permit such an
inspection, but most sellers accept home inspections as a part of the contract. In some
cases, a seller may be presented with more than one offer to buy their property, one with
a home inspection contingency and one offer without a home inspection contingency.
Sellers will often accept the contract without a home inspection contingency. However, the
lack of a home inspection does not relieve the seller for the requirement of disclosure of
known property condition defects. In this day of consumer awareness, unless a seller
is discounting the price of a Maryland home for sale, they will usually accept a home inspection
as a condition of the contract.
Below is the paragraph in the Contract of Sale that covers the Home Inspection Contingency. This contract would include an addendum for a Home Inspection Contingency.
HOME AND/OR ENVIRONMENTAL INSPECTION, LIMITED WARRANTY: Buyer acknowledges, subject to Seller acceptance, that Buyer is afforded the opportunity, at Buyer’s sole cost and expense, to condition Buyer’s purchase of the Property upon a Home Inspection and/or Environmental Inspection in order to ascertain the physical condition of the Property or the existence of environmental hazards. If Buyer desires a Home Inspection and/or Environmental Inspection contingency, such contingency must be included in an Addendum to this Contract. Buyer and Seller acknowledge that Brokers, agents or subagents are not responsible for the existence or discovery of property defects. NOTICE TO BUYER: IF A WARRANTY PLAN IS BEING OFFERED WITH THE PURCHASE OF THE PROPERTY, IT MAY BE A LIMITED WARRANTY. SINCE SUCH WARRANTY PLANS DO NOT COVER STRUCTURAL DEFECTS AND MAY NOT COVER PRE-EXISTING DEFECTS, BUYER SHOULD REQUEST THE REAL ESTATE AGENT TO PROVIDE BUYER WITH ANY BROCHURE WHICH DESCRIBES THE PLAN IN ORDER TO DETERMINE THE EXTENT OF COVERAGE PROVIDED BY THE WARRANTY.
