We address this item because although title transfers at settlement, due to the different escrow and title procedures throughout the country, home buyers new to Maryland homes often don't know the customs and requirements for possession in Charles County.

Taking possession of your newly purchased in Waldorf

At the Settlement meeting, the title attorney will review the HUD-1 with you and the seller. If there were any problems with the deed or any liens on the deed the title company would have contacted us and the seller and advised of the necessary actions to convey clear title. The seller has 14 days to cure any defects or the buyer, you, can void the contract.

Assuming everything is in order, you give the title company your Cashier's Check for the balance of your down payment and closing costs. The mortgage company will have delivered instructions to the title company and sent a check for the money to pay the seller.

Once all of the documents are signed by you and the seller, the title company collects your money and the seller gives you the keys to your newly purchased home. At this time, you may take posession and move in. If you and the seller have entered into a rental agreement for the seller to occupy post settlement, the Post Settlement Occupancy Agreement will be signed and the seller will pay the agreed rent. You may take possession of the home at the end of the Post Settlement Occupancy Agreement. These agreements are in writing and signed by the parties to protect you and make sure your insurance covers the
property at all times.

You become the owner of real property when the new deed is recorded at the Courthouse usually the day following settlement. But, MOST HOME BUYERS TAKE POSSESSION AND MOVE IN THE DAY OF SETTLEMENT.

For homes in Waldorf or other locations in Charles County, the Charles County Treasurer's Office is responsible for stamping every deed and that deed being recorded. The Charles County Courthouse maintains all deeds of record.
